About the Programme
This e-Masterclass aims to advance on your knowledge towards specialised and integrated understandings about commercial law practice in ASEAN+6 contexts.
The ability to draft effective, readable, non-ambiguous contracts is an essential and valuable skill for every commercial lawyer. This practice-based subject advances on the key knowledge and skill required by all lawyers when negotiating and drafting commercial contracts that involve parties, laws or businesses outside of your home country or in more than one jurisdiction.
Topics to be covered:
- analyse the interaction of diverse legal cultures within ASEAN+6 in detail
- provide, and advance on, an overview of key formation-of-contract concepts
- identify and critically discuss the specific skills needed for drafting and negotiating cross-border commercial contracts
- explore ways in which to draft and negotiate contracts that are readable, enforceable and achieve clients’ objectives
- elucidate possible issues, challenges and pitfalls in drafting cross-border commercial contracts
- explore the legal rationale and practical knowledge underpinning contractual clauses
- critically discuss certain boilerplate clauses in detail
