About the Programme

The Personal Data Protection Commission (PDPC) administers and enforces the Personal Data Protection Act 2012 (PDPA). It has established an Active Enforcement Framework (AE Framework) to guide organisations on the conduct of investigations by PDPC and the enforcement actions PDPC may take if it finds an organisation has contravened the PDPA. In the course of an investigation, organisations are required to provide PDPC with the relevant information relating to the incident, which may include its response to the individual(s) involved and the measures taken, or which will be taken, to address the matter. In appropriate cases, organisations may wish to seek an expedited decision or give a statutory undertaking.

This webinar is intended to give participants a good understanding of PDPC’s approach to investigations and the benefits of different options such as the expedited decision or undertaking. The webinar will issues relating to organisations’ response to an investigation, such as making representations to PDPC, preserving legal privilege and ensuring availability of evidence.
